316.1576 Insufficient clearance at a railroad-highway grade crossing.
(1) A person may not drive a vehicle through a railroad-highway grade crossing that does not have sufficient space to drive completely through the crossing without stopping or without obstructing the passage of other vehicles, pedestrians, railroad trains, or other railroad equipment, notwithstanding any traffic control signal indication to proceed.
(2) A person may not drive a vehicle through a railroad-highway grade crossing that does not have sufficient undercarriage clearance to drive completely through the crossing without stopping or without obstructing the passage of a railroad train or other railroad equipment.
(3) A person who violates this section commits a noncriminal traffic infraction, punishable as a moving violation as provided in chapter 318.
(a) For a first violation, the person must pay a fine of $500 or perform 25 hours of community service and shall have 6 points assessed against his or her driver license as set forth in s. 322.27(3)(d)7.
(b) For a second or subsequent violation, the person must pay a fine of $1,000, shall have an additional 6 points assessed against his or her driver license as set forth in s. 322.27(3)(d)7., and, notwithstanding s. 322.27(3)(a), (b), and (c), shall have his or her driving privilege suspended for not more than 6 months.
